The post-election violence that rocked Kenya was a spontaneous reaction to the blatant-rigging and irregularities in the vote-tallying process and not incitement as some PNU members would like people to believe.

In fact, PNU and the government spokesman Dr. Alfred Mutua have not helped the situation at all. Mutua’s appearance on international media has served more to embarrass the nation than help Kibaki’s futile attempt to shove himself down our throats. His arrogant  statements in attempting to cover-up the tragedy of the situation on the ground come off as a sad horror comedy.Sadly though, Mutua is only doing his job, the way he knows it.

Judging from the results in many constituencies where Mwai Kibaki trailed Raila Odinga badly, or where Cabinet Ministers were felled including those like VP Moody Awori who lost to political neophytes or the well-documented real-time constant media updates on the results from the constituencies, and the weird way the ECK mainly composed of Kibaki plants handled the process, makes his election one of the worst stinkers in memory.

Kibaki is now president because he managed a successful ECK and High Court-facilitated coup, which denied Kenyans their true presidential choice - Raila Odinga.

Many crimes were committed here. Yet those who committed these crimes are now asking that Raila and the ODM follow the law. How ironic.

The rush to swear-in Kibaki also showed a well-orchestrated plan to rig the election, throwing the country into a constitutional limbo which effort most unfortunately included among its co-conspirators the nation’s top law men, Attorney General Amos Wako and Chief Justice Evan Gicheru. These two presided over the highly suspect ceremony just an hour after disgraced ECK chairman Samuel Kivuitu announced the flawed results.

The solution to the current situation is not a government of national unity. We have been there, we've done that, and it clearly did not work. The solution cannot lie in giving Raila the vice-presidency or a premiership. That is an insult to the man Kenyans roundly elected. It is also a solution would also reward naughty Kibaki by putting him in charge of people who have through their votes declared that they do not want him, in other words it is a recipe for more chaos in the country.

The solution that would bring back integrity to the whole process in another presidential election conducted as soon as possible. The MPs should be sworn in and a transitional government run by both Kibaki and Raila should be formed to manage the affairs of the country for three months, within which an independent body acceptable to all participants should be named to conduct the polls. The number of votes should be announced at the polling stations in the full glare of the press, observers and public and then everything should be transferred to electoral body headquarters where the final tallying will be done in public with all parties represented.

To the winner the spoils and then Kenya can move on with a legitimately elected president.

A New Constititution

It is rather apparent, as has been since last decade, that a new constitution is what we so desparately need. In addition, it just might have averted this nightmarish life Kenyans have experienced post election.

This is simply false. Some of the violence in Nairobi and Kisumu appears to have been spontaneous. But ODM activists in RVP openly promised, during the electoral campaign, that Kisiis, Kikuyus and non-ODM Luhya would be removed when the Presidency was won. The militias have evidently been well-prepared and financed: there are credible reports that they have maps and other systematic information about the homes and property of the affected ethnic groups; there are also credible reports that the militias were recruited well in advance of the campaign period. It is unlikely that PNU was doing the financing or recruiting.

In any case, one can't simply ignore the conduct of the ODM campaign. It was openly and ferociously anti-GEMA, as has been quite well-documented elsewhere. My own little vignette: a relative of mine has been unable to collect rent since 2005; every time she sent an agent to her Luo tenants, the poor man was chased off the property by panga-wielding thugs chanting political slogans.

Well your 'spontaneous' reaction in RV is been looked at by international agencies committed to prevent genocide as such. check out this website.

Kibaki rigged and we are appalled by it but organizing to burn infants in churches has revolted humane ODMers. One must wonder what other MoU Raila must have gotten into. Votes for Corpses maybe?
And by the way, you sound a lot like the Bagosoras and the Bizimungus who kept touting the Rwanda genocide as spontaneous reaction to the president's assassination.

As usual the ODM's supporters do not fail to disappoint. The PNU's rigging was only a response to the ODM's brazen vote theft in Nyanza. If the PNU had not rigged in response to the rigging, we would have found ourselves in exactly the same situation but with the sides reversed.

Our election regulations make it such that once you are announced by the ECK boss then you are the winner, it is a fait accompli, regardless of what else has happened.

This is why the ODM initially worked very hard to ensure that Kivuitu announced them as winners. This is why they rushed the vote-counts in ODM areas, and that is why they colluded with KTN to bring about the perception that their lead was unassailable. It is only after it became obvious that Kivuitu was announcing Kibaki as victor that they tried to delay him.

But what of the post-election violence. We have already established that those who engaged in these lawless acts started before the election results. Perhaps more importantly there was already warnings to Kikuyus, Merus and Kisiis in these ODM regions. The Kikuyu would still have been kicked out of the Rift Valley (this was always the plan) and the Coast (again this was always the plan) and from Kisumu (again always the plan). The unrest in Nairobi would still have come to pass (the general landlord-tenant relationship was already damaged) and Kenya's name would have suffered not just the irreparable harm of having cartoons like Raila and Ruto as its leaders, but also the very deleterious effects of their economic policies.

Facts

Let us get the facts right:

1. Rigging took place in ODM and PNU strongholds.

2. Kibaki is legally the President of Kenya.

3. ODM and Odinga do not have faith in the institutions of government (judiciary and ECK).

4. Violence was in Nyanza and RVP.

5. The violence in RVP was organised and not reactional.

6. The Kenyan constitution does not provide for a solo presidential election so what Raila is asking for, is unconstitutional.

7. If Raila is serious about the rigging, he can fail to show up on 15th Jan at 14.30 for the swearing in at the house of Parliament.

8. ECK Chairman was reappointed with Raila and ODM's insistence.

9. Kibaki has corrupt elements within his administration and so does Raila.

10. Kibaki outsmarted the ODM, if they really thought Kibaki was going to rig as they kept telling us, why didn't the just boycott the election.

11. ODM nominations show how well they too are capable of rigging...

Kenya a Waste of Time

It is now apparent that Central Province people think carefully about crafting our own destiny.This could well be achieved by having our own separate state like Switzerland and probably build some kind of commonwealth with friendlier tribal states.It is not worth priding ourselves with Kenya we cannot live comfortably without being attacked by tribal gangs simply because we are an able society.
GEMA people have seen what Majimbo means to the tribal people.They simply cannot distinguish Kibaki the president and his ethnic persuasion.

Raila is a disgrace, he has lured the Luos to believe he is their messiah which is a dangerous trend to the rest of the country. Kikuyus react in fear of an anticipated Raila leadership which we now have seen what it clearly could be.

the underlying issue in kenya is tribalism. let us tackle that. there is no sense in talking about the elections as that was a mere trigger on what was already in many peoples' hearts and minds. people voted in tribal blocks and for those who voted otherwise were made to feel guilty like they betrayed their 'people'. the one going circus in kenya is only going to hurt you and me while the kibakis, railas and rutos go on with their lives.
so how do we as kenyans not kikuyu and the rest.. deal with the situation at hand.. i.e. tribalism.. like kivuitu said on t.v... you are not more kenyan than me....

First off,

Thanks editor for posting this but the editing is kinda off on some parts. Anyway, for those who care, here's the original unedited piece posted in Kenya is Burning blog.

I have to say I find it interesting when people say Luos should avoid hero worship when they do exactly that themselves.

It's also sad that the people who ran their mouth the most about the unfairness of the Arap Moi's government are the same one who fully support the unfairness by Mwai Kibaki.

God forbid but if this stalemate continues and Kibaki continues to behave as if Kenyans' opinion don't matter, the oppressed might be forced to turn to extra-judicial means to secure their place in Kenya.

Kenyans want peace and peace can only be achieved through equity and respect of the democratic process.

Ralph, I find this remark offensive whenever you ODMers talk about it. Kwani who voted for Kibaki and Kalonzo? Ugandans? Jamaicans?

Raila admitted on national tv what we have known for a long time. that even his own figures are not credible and where tampered with. With that he came crashing down from the moral high horse. Throw in the ethnic cleansing that has killed hundreds (raila's own figures) and displaced a quarter of a million 'non Kenyans' and you can see why no one wants to touch him even with a very long pole.

Everything that was said about ODM is coming true and your eyes still remain wide shut. You wrote long intellectual stuff about what majimbo was supposedly but it turned out exactly as we had thought; nothing more than a balkanization through mass murder

Elections not the answer,

Murage is proposing an unworkable path a rerun of the election now would be very unfair to supporters of the President.

One of the intended effects of the odm violence and ethnic cleansing was the rigging of any runoff election or election rerun. That is the reason why odm gangs killed and terrorized Kibaki supporters in an effort to create exclusive Raila zones.

A rerun would only be acceptable if the displaced are returned to their homes and are able to vote without fear of being murdered by Raila supporters if they support another candidate.

This would take time those who participated in the ethnic cleansing would have to be brought to Justice. Including the political leadership that paid for and incited those odm gangs of killers.

If all those conditions are met then a rerun would be fair and acceptable to all concerned.

Don\'t be prejudiced

It is true that there were massive irregularities in the election. However, where I disagree with Ralph Murage and international journalists is their claim that the election was rigged by PNU only! That isn't true; in Nyanza province (An ODM stronghold) constituencies like Bondo, Nyatike and Kisumu Rural had impossibly high voter turnouts.

It is farcical that Mr Murage portrays Raila Odinga as a victim yet he (Raila) made inflammatory statements during the time of announcement of the Presidential election results. Raila was quoted as saying that President Kibaki called him and conceded defeat to him prior to the announcement of results!

Don't get me wrong, Raila is the shrewdest politician in Kenyan history (besides retired President Moi) - I have nothing but immense respect for the man. However, he was beaten at his own game. ODM rigged but PNU rigged better (but were less discrete), therefore they clinched the Presidency.

If elections are to be held, more violence is likely to be experienced but definitely a Kibaki victory would be imminent: for Kenyans now have been exposed to the real enemies of the people - ODM. The violence witnessed was a direct corallary to the Majimbo philosophy that ODM was trying to preach throughout the country.

I think owing to election flaws on both sides, ODM should simply take up the role of a strong opposition to keep the government in check. That's right, ODM should accept the results as they are. Mwizi mmoja (Raila) hafai Kukashifu mwizi mwingine ( Kibaki).

As for the 'spontaneity' of the post-election violence that is out of the question. Just think sbout the spontaneity of some rowdy youth casually burning a Church with WOMEN AND CHILDREN IN IT! We weren't born yesterday, if Raila won the elections the skirmishes would probably have been worse - an ODM government would let its supporters carry out such crimes with impunity. Thank God for Kibaki win (who isn't entirely clean) and exposing ODM for what it really is, a group of wicked bloodthirsty hooligans trying to wipe out the GEMA community from the face of Kenya. I apologise for any tribal remarks.
