While violence and looting has subsided in some parts of the country, in several others many are fleeing their homes as violence escalates. Most cities are ghost towns as residents fear leaving their homes. [UPDATE: Time in Kenya: Jan 1st, 11:24pm]

[December 31st, 2007]

In a press conference in Nairobi, earlier today, Police Chief General Ali has dispelled fears that the members of ODM's pentagon have been arrested. He also assured Kenyans that neither him nor any army generals had resigned. 

In a separate press conference, member of parliament elect, Kalonzo Musyoka (ODM-K presidential candidate) is seeking audience with President Mwai Kibaki and Raila Odinga (ODM presidential candidate). Kalonzo also confirmed that Raila was not under house arrest.

According to media reports, there are at least 124 deaths in post election violence. Citizens continue to report hearing gun shots even during the day.

in Kisumu, the BBC reports that many people have moved out of the suburbs into the rural areas in fearing the violence that has descended on the city. Water supply has also been cut off.

A curfew has been imposed on residents of Kisumu according to Sky News with police being ordered to shoot to kill.

BBC radio also reports that Kisumu/Namanga border has been closed.  

Kenya Media is protesting the ban on live broadcasts with the Media Council and the Media Owners Association describing the order as "retrogressive and an afront on the freedom of the press". Read the report from the Daily Nation here.

Raila has cancelled today's Uhuru Park rally where he planned to be inaugrated as the "People's President." He is instead calling for a peaceful milion man protest march on Thursday, January 3rd, across the country. "Party supporters will wear black bands, cloths and carry twigs only." In various cities in the US, Kenyans are planning protest rallies.  

Government spokesman Alfred Mutua had a press conference where he alleged that the violence in the country is very small and has been contained by police officers.

On Al Jazeera, Finance Minister Kimunya urges Raila and ODM to take matters to court. "People will get angry and rise up, but will cool down in the next couple of days."  He said the real test is for ODM leaders to take charge. On a question about heavy police forces deployed in poor areas, Kimunya said," the duty of the government is to protect."

He says the Raila created a hype on rigging so that when Kibaki won people would be suspicious of the results.

In a PNU confrence, its leaders appealed to Kenyans to resume peace. "We are seeking diplomacy, and reaching out to ODM leaders."

Almost 40 people, mostly women and children, are dead after a church they were taking refuge in Eldoret was set on fire. Read more here

There have been reports of rape on women by both government police (GSU) and opposition mobs. 

President Kibaki has called for a meeting with all political parties to try and diffuse the situation. Raila, on the other hand, will only meet with Kibaki on condition that he steps down as president with a new presidential election.

In an interview with Al Jazeera , Raila absolves himself of any responsibility on the situation in Kenya. 

An estimated 200 people have died around the country. Over 70,000 people are displaced with no food. Those who can are stocking on food as shortages increases across the country. (54,000 displaced in Rift Valley, 16,000 in Coast)

Eric Kiraithe-Police Commissioner, "Police is shocked at the level of violence. They are stuggling to maintain peace." 

Government bans opposition million man march that is set for Thursday. ODM has confirmed that they will go on with the rally.

The following text message was sent out in attempt to curb the rumors that have been going around following President Kibaki's swearing: “The ministry of Internal security urges you to please desist from sending or forwarding any SMS that may cause public unrest. This may lead to your prosecution.”

From KTN: Kivuitu contemplated resigning due to the pressures (from ODM and PNU) on him during the last days before the election. Both parties wanted him to announce results immediately, while foreign observers urged him to investigate the alleged rigging. "I had to weigh my options and see which decision (announcing immediately or delaying the announcement) would create more peace).

According to media reports many Kenyans are fleeing into Uganda.

That Raila has backed away from a parralel inauguration is a positive step in the direction of a peaceful conclusion and hopefully the protest on Thursday will be as peaceful. We can onlky hope that that the atmosphrere has cooled enough for the return of Broadcasting stations to the airwaves and that some kind of way can be charted forward.

New Constitution? Clean Cabina

Indeed Raila made a good decision not to hold the rally in Uhuru Park. Much of the "demonstrating" has been hijacked by criminals bend on looting.

Kibaki if free to plead that people accept the election results but it is an insult to anyones intelligence for him to claim that the elections were "free and fair". I really don't see though how he could run the government without support from ODM and ODM-K. What possibly might happen now is that ODM and ODM-K use their palimentary majority to adopt the original bomas-draft of the constitution to be implemented immediately and dramatically reduce Kibaki's powers as president.

Nevertheless, I am interested to see this "clean hands" cabinet that Kibaki said he would form - even though I have lost all respect for Mr. Kibaki (I can't call him President)

A lame duck president depending upon parliamentary assent is certainly not the worst that could happen to Kenya. I would be much more afraid of a bigman with a rungu.



As to a "clean hands team", it's up to the voters. With a dysfunctional constitution as the Kenyan one, you have to take ministers from whatever crooks people have (re-)elected into Bunge. As president, you just cannot freely and simply choose good, competent, honest ministers, since your choice is limited.

After watching the looting in Kisumu and Mathare, and then read what "an" writes, I think the police should just have let these people steal and left them alone.

I do not for a moment think that the proprietors of Crater Motors in Kisumu stole the election and the damage in their showroom only tells you that it was not legitimate protest that the police were dealing with - but criminals.

I would like to believe that you can protest an injustice without damage to property or loss of life.

God always Wins

If God wanted Raila to Win, he would have won no matter what, If God wanted Kibaki to Win, He would have won and He has indeed won the elections. What disturbed me most was Raila's audacity to go and Lie in the church of God that he didn't have a deal with Muslims and yet later on he admitted he did. It is one thing to lie in the public arena and I am sure President kibaki and all other politicians have, but to lie in front of God's congregation is simply Disrespecting God. Raila is just paying for his actions. He is being punished by God. I also want change, but I believe the kind of change Raila purported was not the right kind of change. Forcefully taking away wealth from one group and giving it to another is not the right way of distributing wealth but rather tax reforms and developing infrastructure in every part of the country is the best way. Socialism should never have a place in todays democratic world. I believe in the current circumstance, that none of the candidates have been anointed to bring change to the country, we simply have to wait for 2012 when I believe the young generation who have rejected their tribalism heritage and old way of doing things will finally usher Kenya into a first world country.

Simplistic and misleading stat

You make a very simplistic statement - that Kibaki won because God is with him. If that is so then God was with evil men like Sadam and Hitler because they also won elections in their country. I am not saying this to compare Kibaki to either of those two dictators - I think Kibaki is a better man than them. It is however important to state that God gave us free will which allows us to do good things, like helping the poor, or sometimes evil things like rigging elections.

I cannot comment on whether or not God is punishing Raila ... I think God's judgement of Raila rests with God alone.

I am a Christian and I agree that God always wins ... but I also believe that we all have a choice. God's ultimate interest is not in who becomes president but in how each of us individually comes to know Him (God) and realize His love for us.

Remember ... in the Old Testament the Israelites cried for a King, even though God told them that they did not need one.

Be careful about saying that God is with the person who wins the election - Hilter won his election by a landslide.

Raila is the real cause of the Violence, it is only pro-Raila supporters who are causing the violence, they have no right to loot or kill kikuyus which I hear has been happening. I also object to luo's and all other kenyans being killed, they are giving their lives to selfish leaders who will never know they even existed. I agree with what young generation posted.

Enough with the Raila or Kibaki is responsible for the violence that is not going to bring back all the TVs, Fridges, Loafs or sodas that have been taken away or even those who have died. What would be useful is if the ring leaders of the mobs were apprehended and convicted in a court of law as under the Constitution. Also an Investigation of the counting and tallying of votes would answer a lot of quetsions

No matter what raila or his supporters say, he can vent and rant all he wants,but he shouldn't cause his supporters to be violent and make it seem as if the country is the in the midst of civil war all for attention. He is like a child who will do anything to get attention.He just won't let kenya be peaceful if he is not the president, That is not the sign of a wise or democratic leader.

Things are not going right for

What is all these I here that Raila has been in a meeting with international countries. I don't why he is doing that, at the end of the Day, they won't invade Kenya to force Kibaki out. Nor can they give Kenya sanctions so that Kibaki will retire, I don't think so. They will just accept it and move on. Raila if u want to get the right place to seek reddress, go to parliament. And even if there is another election, the Gema cummunity will probably back Kalonzo, Either way, it looks bad for Raila.

Personally I am Happy that Kibaki won, I keep wondering what if Raila won, what would Kenya be like and after all now I have gotten to know that his supporters were hooligans.
But still my heart is hurt to know that kenya has descended into violence by a few youth, My heart goes out to all the families who have lost their loved ones, be they luo, kikuyu, they are all kenyans and Gods children to me. And I love all Kenyans and My country.

Raila as a statesman

Going by what i saw at the press and also in print media about the candor and conduct of Raila; it is presidential befitting a statesman.
While , the illegally sworn in president has decided to do what he likes best; sleeping when the country is in flames; Raila asked his pentagon members to quell the chaos, asked the supporters not to engage in street fighting. This is a man robbed of victory yet he is resolute and means well for the country.

When can we as kenyans grow up and realise that whether you eat githeri, muthokoi, busuma, fish, pilau: it all comes out one straight way stinking and after all is sai and done, we are all human beings.

We need each other for coexistence.
It is not time to thump your chest and take others for granted or ridicule them.

for we know that the ilks of the Kombos, Karumes, mungatia, michuckis, lucy, kibaki are the ones fueling this animosity in the country.

The president has not even addressed the security concerns in the country ; neither has the Michuki.

It is sad that we have been taken back 40 yrs back, precolonial; no wonder we have a a colonial admiministartor running the security of kenya with no clue as to the ramifications of myopic risky undertakings.

It is sad for common people; the mama githeri in kisumu, or mama samaki in Nakuru; what have they to do withthe likes of the ......

I just came from a party celebrating President Kibaki re-election here in the U.S, I don't see any reason why President Kibaki's victory should not be celebrated. Infact I will continue celebrating it. But My heart also goes out to all those kenyans who have been injured because of Raira. GodBless Kenya

The price of democracy can literally translate to a few deaths ---if Raila does not set precedence for us then some of us will never get that presidency. I come from a small tribe in KENYA and seek the help of larger kenya to set the records straight once nad for all.

Raila a Statesman?

I really hope for the future of our country that Raila cares more about Kenya and her people, than his ambition to power.
By all accounts, rigging on both sides accounted for or not, Raila and the Baks had a pretty even split in total votes. No matter which one really won, it was by the slimmest of margins. IN NO WAY WOULD THESE RESULTS BE A MANDATE FOR A POPULAR UPRISING, OR 'ORANGE' REVOLUTION.
Kibaki has roughly as much support as Raila. This is not to discount inconsistencies in the electoral process. All verifiable claims of rigging ON BOTH SIDES should be investigated, and dealt with in a legal and constitutional way.
Only by respecting the rule of law, and placing the lives of Kenyans above personal ambition can Odinga prove that he is more of a Statesman than Kibaki, and allay the fears of those who perceived him as too militant and tribal. The self-same fears that probably drove some misguided PNU supporters into pro-Kibaki rigging.
The Kikuyu, and all other Kenyans have been robbed, just as surely as Raila and the Luo have been, because we will probably never know for sure who would have won a free and fair election. The ODMites had, however, raised the stakes, and political temperatures so high with their unwillingness to accept anything other than an ODM victory, that their self-fulfilling prophecy has come to pass.

Now here is a bunch of Kibaki supporters who may not have even voted for him celebrating his 'victory'. Did you remember to pray for Kenyans before indulging yourselves in keroro? I have no doubt that you wrote this while drunk or your level of intelligence is wanting. Even if he makes to stay in office illegally, what matters is the net perception of Kenyans right thinking or not. It is now an ethnic thing and who i pity most is those from Mt Kenya who will be attacked innocently in the rest of the country for God alone knows how long. I wonder how kazi will endelea with all the negation on the economy and all sectors that has been done. The right thing would be if Kibaki resigns and let justice prevail, anything short is a deservice to Kenyans.

Your commentary is not from a minority tribe it is simply only yours alone. President Kibaki is not messing your future, did he mess your future in the last 5 years? I don't think so. And neither do I think he will mess it up in the next 5 years.
Instead even though he had to rig to save us from Raira, I think that is the price Kenyans have to pay for ignorantly and Blindly following a leader simply because he wasn't a Kikuyu.

My dear Kenyans, yes i feel the pain for those who are not accepting the results of the elections but in human nature that's normal.Always the losser crys foul.Am a kenyan living in U S and i think i have every right to comment on the issues affecting my country.One thing i don't have a right to is to question the results of just concluded election because i did not vote.Therefore for those Kenyans planning to hold demostrations in U S cities i will say same on you people.Just waiting for the kill from our brothers and sister and start fighting for it. HYENAS. HAPPY NEW YEAR.

Demonising the name RAILA has TRULY worked; even with a little over half a cross-section of the country voting for him!
If Raila stood before us with his elected MPs behind him and Kibaki did the same, which of the 2 groups would TRULY represent the face of KENYA?

Reuben what people are protesting against are the rigging claims and the fact the election was not free and fair.Whether you or I participated in the election doesn't matter but what does is that as Kenyan citizens we should all enjoy and be protected by our system and its laws.

Reuben, I do not agree with you that we should keep quite just because we did not vote.

However, I do agree that demonstrations outside Kenya are a waste of time.

A road of no return

With more than 150 Kenyans killed countrywide, nobody can tell the wananchi to resume their activities and live as before - as if nothing had happened. What will become of the grieved families that lost a loved one or several in the "shoot to kill" rampage by the Kenya police? I am ashamed to be Kenyan today.

Kibaki, Michuki and Ali thought that they would massacre 50 people in Kisumu as a retaliation or punishment and make example to all the ODM mouvement - he got it all wrong. Clashes with the police is now countrywide - mostly in major towns like Mombasa, Eldoret, Kericho, Kilifi, Taveta, Wundanyi and Narok, Busia, Bungoma, Kakamega, Narok, Kuresoi. Even the reference constituency Molo was not spared by violence. This violence will not end, there are too many people angry out there - a countless number of people have been killed in cold blood out there. We should only pray that demonstrators don't get armed by our neighbors.

The ODM party should construct memorials in these towns commemorating the deaths of those who fell from Kenyan police bullets while fighting for the freedom of the country.

Why is Kibaki not sending a political signal? Even four commissioners

Call Your Senators

Effective Wednesday, I will be calling all one hundred US Senators to inform them of Kibaki's state ordered killings.

Having watched the power of students, celebrities and NGOs to bring the issue of Darfur to the fore, I would like other Kenyans in the US, Britain, Australia, Canada and elsewhere to start calling your elected representatives to highlight Kibaki's incipient - in Kenya.

From the sound of things, allegedly victory depended on who rigged last.

What is sad is that thuggery, looting and killings started well before the results were announced.

If that was a taste of what kenyans would have been in for, then declaration of the victory was in order, considering that either of the partys allegedly rigged in one way or another.

PNU voters know that Kibaki rigged. Pro-Raila folks are rightly outraged, but also pro-Kibaki folks are DISGUSTED that they voted for a man GUILTY of fraud. The electorate (you and me) are the ones rising up against this breach of our consciousness.

Raila did not incite this. Kenyans are not robots - they have minds and can connect the dots. Can you?

...truth be told, things won't go bakc to normal just like that; hands have been tainted and minds have been instigated...however, these gov and opp leaders should continue talking and asking 4 calm: silence just builds on misminded assumptions and rumors- this is undesputably a dangerous source od information at this shaky moment: so, if there is something to shout to these 'God-made, Man-chosen' leaders is to start talking to the people and to each other. People usually shake hands then begin fruitful converse; this throwing of words like spears from corner to corner is impeccably futile.

Now, for the Diaspora, of whcih I am bone and flesh of, we need to come together and talk and ignite some fire from this side; before we go yelling Help to nations which make 'gambling chips' out of our homelands, lets trade opinions through discussion with them that have been rained on....kenyans themselves. So, diaspora, we got work to do (lets take ghanaian diaspora as good example).

I hear Raila has has climbed the shoulders on Farrakhan by calling a 'million man march'. Let us hope that words poured at this congromeration will be those of peace and co-existence rather than incitement.

Finally, let us continue to pray. For those who think that we are just enjoying the democracy of foreign lands, be you informed that some of us have our entire families back home and have counted one-to-many sleepless nights saturated with worry and anxiety.

Let people speak, let them shape and sharpen their words wisely, and MAY GOD CONTINUE TO WATCH OVER OUR BELOVED NATION.

The just concluded GE was too close to call it one or the other. As I beseeched many pre the election, Kenya is for all Kenyans and insulting, killing, looting from your fellow Kenyan over some corrupt politician does not really showcase your intelligence in the best light.
Even Kibz is being asked to step down for RO, likewise RO should consider chilling out and going on to become the best Opposition leader Kenya ever had.

If in broad daylight PNU can rigg election, how sure are we that they can fight corruption as they are using corrupt means to get to power. Is there something they are fighting to hide. Kenyans read between the lines. Innocent lives are being lost just because of power.

ECK should take the blame and

ECK should own up to the mess with counting and tallying of presidential votes. It's disturbing that in several constituencies beside the Maragwa case, had turn out of 100%+. How could that be without ECK's officials colluding?

ODM and particularly, the 'peoples' president' and his vice incited their supporters by announcing fake results and declaring themselves president and by implication vice president respectively before results from 50+ constituencies were reported. That was reckless leadership.

EU chief observer's panic has over played the Molo result descrepancy. First, given the large turn out in general everywhere, I doubt that Molo with 126,372 registered voters could only account for 55k and 23k (sum 78k) votes for Kibaki and Raila respectively. This less than 62% turn out, which quite low for Molo. In tallying the results, ECK officials may have noted this was suspicious. That's why I second the idea of a recount not only in Molo but every other of the 210 constituencies. For justice to be done, it is only fair a full and toal count of presidential votes is revisited.

Legal technicality on the matter makes ECK incompetent to resolve the issue after it has announced the results. Raila can indeed move to court of law and petition the results on the various grounds it has indicated in rejecting the results. Kibaki could also move to court to petition the ECK and opposition for declaring his win a fraud and demand authentification of the same. Finally, a voter could also take the matter to court on either side and demand to know the truth about the final results for the presidential election. The courts would be duty bound to give the matter top priority in the interest of the country.

Now that Kibaki has taken oath of office, there is not much else that can be done unless he dissolves the 10th parliament and calls for a fresh general elections, i.e. a repeat of the entire electioneering process. This could be best but very costly solution.

It's nonsense for Raila and whoever gave him legal advise that going to court would be a waste of time. His decision to go for the public opinion on street justice is ill adviced. That is what will mess his reputation. He should know better the consequences of doing this, and I am very sure he only wanted to threaten government.

Media houses just like ODM have been a major let down for inciting the Kenyans into street protests. These have gone wild and out of hand. The resulting looting, killing and destruction of property that followed go a long way into demonstrating they type of leadership Raila has in store for Kenyans. It has not added any value at all to his case. He must play a greater role to counsel his supporters.

Reconciliation efforts that are being tried, seem to have started on a failure foot, after Raila poured cold water on Ambassadore Kiplagat's character, which a little surprising to me. He is generally widely held in high esteem though by most Kenyans. Raila's demand that Kibaki resigns first as condition for dialogue, defeats any porpose of trying the effort. This shows Rila is hard bent taking to the streets, and charge the supporters for a revolution.

An 'Orange Revolution' will however be too muc a bite for Raila to make it. He must remember that there are just as many of Kibaki supporters as his own ODM supporters. He should also know some of his ODM supporters would not go that route anyway. 1992 election rigging by Moi against Matiba woud have been gpood reson for the country to take on a revolution, the kind Ukrain has, which is what Raila is contemplating. That will not work.

THE VERDICT OF kENYANS IN THE

Kenya deserves to continue enjoying the peace it has fought for all these years. No one should subject Kenyans to the chaos we are witnessing now The so called leaders must now demonstrate their capabilities to lead by ralling Kenya to unite for a peaceful settlement of the current volatile situation . The leader who will excell in this will not just be a person after the top seat or one bent on clinginging to power no matter what it may cost the rest of the popupulation but one who will be a symbal of what our national anthem stands for. God help us with that leadership

Kenyans are known to be people who easily forgive the past to get on with the actual bussiness of the nation. ECK must lay the truth of the election results out on counts at the polling station level to the national count as obtained at the close of the polling We must be told which figures were used to annouce the winner of the presidential vote. If a mistake was made to declare a wrong candidate then we expect that Kenyans' will, will be respected with a resignation On the other hand if the ECK verdict is affirmed then the opposition will do the gentlemanly thing by openly apologizing to the nation and accepting the verdict of the majority congratulate the winner and shake hands for the sake of the nation. Let those who have been aspiring leadership in Kenya stand out now.

I cant help contrasting the aftermath of the elections of 2002 and the just concluded ones and Kibaki is a constant in both cases.

International and domestic observers have questioned the veracity of the figures presented by ECK. Four commissioners have broken ranks with their colleagues. EU, US and Canada have questioned Kibaki's mandate. I can't believe any sane person can not see that Kibaki's "victory" is flawed.

President Harry Truman had this caption in front of his desk: "The buck stops with me". The degeneration of Kenya into chaos can only be placed at the door of the one person who lit the embers by trampling on the rights of Kenyans: Mr. Kibaki.

As of the day before Kibaki was declared the winner, the EEC and others had all in a unison voice affirmed that the election were conducted in a free and fail way, how is it that they only took notes of the malpractice after Kibaki won.

The ODM rigged elections, it commenced the rigging furore at an early stage some of its constituencies have 99% and above show, this is unanimously agreed that it is for the love of Agwambo that there was a larger than normal vote. Any large vote of the same in Kibaki stronghold is prescribed as evil rigging.

Oh my foot! The Holy Grail, stolen rights a snatched victory of some sordid sort.

The ODM were not keen on a free and fair election, they did not even tolerate or exercise it in there own internal elections.

It is amazing to me to see all the odm supporters here trying to justify the genocide and ethnic cleansing. Let me make it clear to me and indeed to humanity at large there is no excuse for ethnic cleansing and genocide. Not rigging or anything else. ODM leadership which planned and incited this violence will be brought to book. We are calling for an international investigation into the ethnic cleansing and genocide now going on in Kenya. The international community should shun the perpetrators of these crimes against humanity. We are starting a letter and phone campaign calling on the AU, UN, EU, USA, UK to condemn the ethnic violence in Kenya and for an independent investigation. If ODM political leaders are found to have ordered, planned or incited this genocide then they should be brought before the Hague or another competent international tribunal. We don't want atrial in Kenya because of the tribal loyalties but Raila and company are now international criminals and must be put on trial before the world for the cold blooded murder of hundreds of Kenyans.

I think the violence began soon after the unfortunate announcement of the secretive and hurried swearing in of Kibaki despite the concerns raised by the opposition.

This was clearly reactionary and I beleieve you would be hard put to prove otherwise. Blaming everything on ODM is a tired myopic chorus fit to come only from the Mutuas and Michukis of this world.

I don't think people are justifying the killings but rather just attempting to examine and explain them.

This uprising is not kikuyu vs. Luos, it is the poor refusing leadership shoved down their throats.

Criminality is not an ODM monopoly. There is probably something close to genocide or at least ethnic cleansing perpetrated against both Luo and Kikuyu and by both.
This is about law, order and good governance where leading should be by example not show of might.

The PNU leutenants made the same wild and confused allegetions yesterday at a press conference. When press asked them for evidence that raila and team are fueling conflicts they almost got physical just like the guyz in the streets. Remember they have the entire state machinery (police, CID NSIS e.t.c)to be able to know the truth. So if they have not verified and justified this, you have no basis to go around ranting and bickering like a madman that ODM pentagon has started a genocide. your degenerative imaginations leave a lot to be desired sanity and mental coordination and balance. I would summarily say that you are busy implementing your well calculated hate campaigns against ODM just like the other PNU guyz. Let's try and get to the bottom of the real issues causing the killings rather than the stupid, inconsistent and irrelevant hate campaigns which will lead the country into further disarray.
